BRIAN M. FOLEY

BRIAN Foley is co-chair of the Health Care Law Practice Group at Schenck, Price, Smith & King, LLP, which has offices in New Jersey and New York. He has wide-ranging experience in fraud and abuse counseling, reimbursement, managed care contracts, medical staff issues, employment and compliance matters.

Foley represents providers in state and federal regulatory matters, including professional licensing board matters. He is a member of the American Health Lawyers

Association and the New Jersey State Bar

Association’s Health and Hospital Law Section.

Among his professional activities is his role as former associate editor of HealthSpan,

The Report of Health Business and Law.

Prior to joining Schenck Price, Foley was the vice president and general counsel of

Cathedral Healthcare System in Newark,

New Jersey, and a partner in the law firm of

Kalison, McBride, Jackson & Murphy.

Foley has been included on Morris/Essex

Health & Life magazine’s Top Lawyers in

Health Care Law list every year since 2018.

New Jersey Super Lawyers has also annually recognized him since 2017.

Foley earned a BA, with honors, from Villanova University, and a JD, with honors, from Seton Hall University School of Law. counsel and supervised all of the investigations of the continuing investigation and was the lead counsel for the cases against Elliott Abrams, Alan Fiers and Claire George.

In 1993, following the Iran/Contra presidential pardons, Gillen began private practice in Atlanta. He has a national practice, representing individuals in approximately 20 federal districts throughout the country.

He has won not guilty verdicts at trial for a federal agent, businessmen and professionals, and he has obtained dismissals of criminal charges for attorneys, businesses and corporate officers.

In 2006, as lead attorney, Gillen obtained the only acquittal of an executive in the National Century Financial Enterprises prosecution in Ohio, one of the largest private fraud federal prosecutions in U.S. history, involving alleged losses of $1.9 billion.

He was lead counsel in the successful defense of a Georgia Tech professor in a Georgia RICO prosecution (2016); he served as co-counsel in the successful defense of the CEO of Cobb EMC in a Georgia RICO prosecution (2017); he concluded his representation of the DeKalb County CEO, resulting in a reversal in the Georgia Supreme Court of the trial conviction in and, finally, a dismissal of the indictment in 2016; and in the summer of 2018, Gillen was lead defense counsel in the successful defense of a prominent environmental lawyer indicted in federal court in Birmingham, Alabama.

Gillen earned an undergraduate degree from the University of North Carolina at Chapel Hill, and a JD from Emory University School of Law.

Gillen and his wife Donna have two grown children, Stephen and Kelley. He traces his Irish roots three generations back to Lismore, Co. Waterford on his father’s side, and Co. Longford on his mother’s. He is a descendant of William Durkee, the first Irish Catholic (1663) of the Bay Colony.
