TIMOTHY CAPOWSKI

TIMOTHY Capowski is a partner at Coffey Modica O’Meara Capowski LLP, with offices in White Plains and Buffalo, New York. He has spent 27-plus years at the forefront of the insurance defense bar. He has been in the trenches for some of the biggest and nastiest claims in the history of the toughest legal market in the world.

As the leader of CMOC’s Litigation/Appellate Strategy & Advocacy Group, Capowski brings his hard-won know-how to bear, fighting for defendants everywhere, shaping strategies to identify, evaluate, monitor, mitigate and defend defendants’ risk in catastrophic property and casualty matters of every kind.

Capowski’s practice has always focused on appellate, primarily representing excess insurers in complex litigation (though he did start his career with a plaintiffs’ firm). Most of his career – 20 years – was spent with Shaub Ahmuty Citrin & Spratt, where he started as an associate and advanced to partner and head of the firm’s Appellate/Consulting Practice.

In January 2022, he transitioned his practice and his team to CMOC LLP, where he became a named partner and head of the firm’s Appellate/Consulting Practice. Capowski leads a team of 15 that focuses its time on litigation strategy and early intervention.

Capowski has litigated hundreds of appeals and thousands of motions in state and federal and appellate courts throughout New York, and around the country. His lengthy list of representative matters includes numerous successful appeals and dispositive motions in a wide variety of areas, including catastrophic personal injury and property damage claims, construction defect, product liability, subrogation, professional liability, premises liability, labor Law, employment law, mass torts, complex torts, toxic torts, insurance coverage, and general commercial litigation.

Capowski has been recognized by New York Metro Super Lawyers from 2019-2022. He was an AIG Top Ten Lawyer for 2012, and maintains an AV Preeminent rating from Martindale-Hubbell.

Capowski earned a BS from the State University of New York at Fredonia, and a JD from the University of New York, Buffalo School of Law.

Married with two sons, Capowski traces his Irish ancestry to counties Tipperary and Galway three generations back.
