BENJAMIN Farrell Summers Herd is a partner in the Real Estate & Banking Section at Holland & Knight. Based in the firm’s Dallas office, Herd’s practice focuses on the representation of CMBS lenders. He has led hundreds of loan origination transactions, as well as whole loan sales,syndications,and“b-note”purchases/sales.

Herd also represents special servicers in relation to defaulted or troubled loan workouts, maturitydefaultresolution,collateralforeclosure, lease negotiation, and the sale of REO property. He assists national and regional banks in complex commercial loan transactions, including ground leases, tenants-in-common, and acquisition and multi-tranche construction financing.

Herdhasbeenrecognizedby TexasSuperLawyers since2013,and Best Lawyers in America since 2019. The Dallas Business Journal and the Texas Lawbook profiled him as a top dealmaker in North Texas in 2017, D Magazine cited him as a Best Lawyer in Dallas (2015), and The Legal 500 United States named him as a Recommended Attorney.

Herd is the past chair of the Real Property Section of the Dallas Bar Association. He is an active supporter of the West Dallas Community School, which provides a classical Christian education to one of Dallas’ most impoverished areas.

Herd earned a BA in political science from St. Mary’s University, and a JD from SMU Dedman School of Law.

Herd and his wife Mimi have three daughters: Sofia, Audrey and Isabel. His Irish roots originate in counties Longford, Cork, Waterford and Kilkenny. His mother, a genealogist, discovered her family stems from Diarmait mac Mael na mBo, the (contested) second High King of Ireland from the 11th century.
